A U.S. attorney in Tennessee is reportedly vowing to use federal civil rights statutes to clamp down on offensive and inflammatory speech about Islam.
Bill Killian, U.S. attorney for the Eastern District of Tennessee, was quoted by the Tullahoma News this week suggesting that some inflammatory material on Islam might run afoul of federal civil rights laws.
“We need to educate people about Muslims and their civil rights, and as long as we’re here, they’re going to be protected,” Killian told the newspaper.
While threats directed at individuals or small groups can lead to punishment, First Amendment experts expressed doubt that the government has any power to stop offensive material about Islam from circulating.
“He’s just wrong,” said Floyd Abrams, one of the country’s most respected First Amendment attorneys. “The government may, indeed, play a useful and entirely constitutional role in urging people not to engage in speech that amounts to religious discrimination. But it may not, under the First Amendment, prevent or punish speech even if it may be viewed as hostile to a religion.”
“And what it most clearly may not do is to stifle political or social debate, however rambunctious or offensive some may think it is,” Abrams said.
A conservative watchdog group, Judicial Watch, accused the Obama administration of using federal law to specifically protect Muslims from criticism.
So I suppose Mr Killian wouldn’t much care for my blog.
Killian said Internet postings that violate civil rights are subject to federal jurisdiction.
“That’s what everybody needs to understand,” he said.
But be careful, sir, about that precious First Amendment. Because when you lose the Second, you naturally lose the First. And you, Mr Killian, are doing your best to hasten, concomitantly, the demise of the First.
Cut down from within.
Just as history has seen for many powerful nations, over the span of time.
Be very, very careful.
And you, ladies and gentlemen, be extremely protective of your First and Second.

TUCSON — Despite a recent court ruling that the department run by Maricopa County’s top cop used racial profiling in his quest to crack down on illegal immigration, a recall effort against Sheriff Joe Arpaio has failed.
On Thursday, members of Respect Arizona and Citizens for a Better Arizona — who launched the recall effort against Arpaio — failed to gather the necessary 335,000 valid voter signatures by the 5 p.m. deadline. The aim was to force a recall election.
Activists behind the recall effort would not say how many signatures they were short. Randy Parraz, president of Citizens for Better Arizona, only said the two groups had collected close to 300,000 signatures.
Maricopa County Sheriff Joe Arpaio, who dares to do the job that the federal government is mandated to do but refuses, was re-elected last November — making him a six-term Sheriff.
And by the way:
“Arpaio has promised to appeal the ruling.”

In an interview with Megyn Kelly on America Live, Sen. Ted Cruz (R-TX) reflected on his extensive history as an attorney and used it to weigh in on the increasing scandals surrounding current U.S. Attorney General Eric Holder.
“The conduct of the Justice Department does not inspire confidence. We have seen pattern after pattern with respect to investigation of the media. We have seen the Department of Justice willing to seize the phone records, to seize the emails of this network, of the Associated Press and by all appearances the attorney general went before Congress, stated he had nothing to do with it, it’s become public that he did in fact have quite a bit to do with it. The attorney general needs to come forward and explain what the truth is and why he told Congress something different,” said Cruz.
Pressure, ladies and gentlemen. There is pressure.
I say: let the pressure increase and increase to bursting.

How long, really, did Mr Holder think that he could obfuscate, deflect, cajole and lie outright before someone took him to a bit of task? After all, he is not Barack Hussein Obama.
