Virgin Islands: gun confiscation in the face of Hurricane Irma

The Second Amendment provides that the right of the people to keep and bear arms shall not be infringed, but the Virgin Islands Governor somehow sees a Hurricane exception to the Supreme Law of all U.S. land.

As the Caribbean and United States prepare for the incredibly powerful Hurricane Irma, people everywhere from the Gulf Coast to the Carolinas are getting ready for possible impact. That includes the U.S. Virgin Islands, a territory where the governor has signed an executive order authorizing the National Guard to seize privately owned firearms, ammunition, explosives, and property, The Daily Caller is reporting.

Because, as everyone knows, the US Virgin Islands is the first place one envisions when civil unrest and insurrection is at play. Right?

Wrong. The last time I suspect anyone conjured anything about the US Virgin Islands was whatever thought some Millennial/Gen Z’er had about Virgin Airlines or a hymen.

The governor wildly inflates his importance and the actual efficacy of the order unless the USVA is a hotbed of crime, gangs and violence — in which case the governor is massively negligent for allowing that situation to occur in the first place.

Governor Kenneth Mapp signed the order on Monday ahead of the Hurricane’s landfall. The order allows the Adjutant General of the Virgin Islands to take personal property that it believes is necessary to protect the islands. That apparently includes residents’ personal firearms and ammunition, along with whatever other property is deemed “necessary.”

Not just the outright confiscation of firearms, but the confiscations of any and all amounts or property, no limits.

AYFKM? No, sadly, I am not.

This well and truly comports with the Second Amendment’s hurricane exemption.

Remember that this is not the first time that firearms confiscation measures have been implemented in response to a storm. After Hurricane Katrina, police confiscated firearms from quite a few people in New Orleans without due process of law.

Despite their inability to cope with the resulting mayhem, several days after the storm passed New Orleans officials ordered the confiscation of lawfully-owned firearms from city residents. In a September 8, 2005 article, the New York Times described the scene, stating, “Local police officers began confiscating weapons from civilians in preparation for a forced evacuation of the last holdouts still living here… Police officers and federal law enforcement agents scoured the city carrying assault rifles seeking residents who have holed up to avoid forcible eviction.”

Of course, I’m lying my arse off. There is no exemption to any portion of the Second Amendment for the purposes of a hurricane or any other exigent situation.

The National Rifle Association (NRA) is threatening legal action to stop a seizure of guns and ammunition by U.S. Virgin Islands Gov. Kenneth Mapp (I) ahead of Hurricane Irma, the group said Tuesday.

“People need the ability to protect themselves during times of natural disaster,” said Chris Cox, executive director of the NRA’S Institute for Legislative Action. “This dangerous order violates the constitutional rights of law-abiding citizens and puts their lives at risk.”

Let’s place a bit of historical significance around the issue, shall we? Remember, as some instructors said to me during various classes in university, “you may see this material again.” Or, “contrast and compare.”

Hand me my blue book.

New Orleans Mayor Ray Nagin signed a similar order in 2005 amid the destruction from Hurricane Katrina allowing the seizure of private weapons, which the NRA opposed in a federal court. Congress later passed a bill, supported by the NRA and signed by President George W. Bush, banning future seizures of weapons during emergencies. 

Apparently Governor Kenneth Mapp is well and truly that ignorant and that dictatorial. He has evidently purposely forgotten this. Would I be correct to suggest it’s no mere oversight?

Let’s go one video further. Did you hear of this? Did you read of this? Likely not. Government pointing live weapons at civilians in times of — what — flooding? At minimum with .223 long guns? To what end? Were you anticipating nothing but looters and/or drug dealers? I would hope there is more to the story.

That was just fine, right?

RESIDENTS WERE HANDCUFFED ON THE GROUND. IN THE END POLICE TOOK THEIR WEAPONS. BUT LET THEM STAY IN THEIR HOMES.

An actual Oathkeeper.

And that is what you get for deigning to live in any number of hundreds of Urban Rat Cages in the United States of America, once free, once jubilant, once unfettered.

I’m sure Governor Mapp is certainly in keeping with the Leftist’s meme of gun control, gun confiscation. Because I posit: where are the orders and the procedures delineated for returning these firearms to the citizens? Answer: they don’t exist. There is no such animal. Therefore there is no plan for it.

Confiscation. Permanently.

Knife control: Japanese man kills 19, injures 26

(CNN)  At least 19 people were killed and 26 injured in a stabbing spree at a facility for disabled people west of Tokyo, making it one of Japan’s deadliest mass killings since World War II. Nine men and 10 women, ranging in age from 18 to 70, were killed in the attack.

Officer Satomi Kurihara of the Sagamihara Fire Department confirmed the death toll at the Tsukui Yamayuri-en facility in Sagamihara, a residential area approximately 40 kilometers (25 miles) west of the capital.
Satoshi Uematsu, a 26-year-old who worked at the facility until February, broke in through a window about 2 a.m. Tuesday (1 p.m. ET Monday), Kanagawa Prefecture officials said at a news conference.

Because, as we all know — and Leftists know this best of all — if we eliminate firearms wholesale, then violence will simply plummet and go away.  All will be well with the world, birds will sing, clouds will part and the sun will shine.

Yes, Leftists are in fact that naive.  Logic and the nature of humanity, as I’ve written before, eludes the deluded.

When firearms are eradicated, violence will cease.  Right?  But wait; what about Australia, where gun deaths are down but knife deaths are climbing.  Why might that be?  Let’s glance at China, where a knife is the weapon of choice and 130 persons were stabbed at random.  36 persons were stabbed and killed at a Chinese police station in 2013.  Eight children were killed by a knife-wielder in Japan.  Eight people killed in South Korea.  41 people were stabbed by a 16-year-old in Berlin.  A 13-year-old girl was stabbed to death in the UK.  The knife is the UK “weapon of choice” for violence, as it is in Israel with Palestinians stabbing and killing Israeli citizens.  FBI data indicates you are more likely to be beaten, clubbed or stabbed to death than to be murdered using an AR-15 or any other rifle in the United States.

In Europe, guns are involved in 36 percent of murders and knives are involved in 43 percent.  Where is the cry for “knife control”?

Locally, there were a number of knife attacks last year.

But let’s stop dancing around the issue of “gun control.”  Let’s get down to brass tacks: Demorats and Leftists want out-and-out gun confiscation.  Make no mistake about that.  Hillary Clinton and all other power elites have their own private police forces.  You don’t.  They have “theirs” and that is all they care about.

When you get down to it, Leftists and Demorats will only be satisfied when there exists the complete removal of firearms from American citizens.  The outright trampling of the Second Amendment.  What’s left?  Tire irons?  Knives?

But here’s one thing you won’t be able to do with a knife or a rock or a lamp or a baseball bat or a torch or a pitchfork: defend yourself against a government.  Oppose oppressive government regimes.  Governments, all governments, our government, will always be armed with heavy, military grade weapons.  Historically, our Second Amendment does not exist to allow Americans to hunt.  That’s a ridiculous claim when made by anyone.  The Second Amendment exists in America in order to resist tyranny in any form and that includes an over-reaching government, foreign or domestic.

Demorats and Leftists are not grounded in reality.  They are only versed in power and money.  The citizenry can be armed or it can be disarmed.  Those who are disarmed are called Proles, Serfs, Groundlings, Commoners.

In the meantime, criminals will still commit crimes, the mentally unstable will still be unstable, and Leftists will still be unable to grasp these fundamental concepts.

Ah yes, another reason that Leftists are more predominently becoming indistinguishable from Muslim terrorists, advocating the wholesale slaughter of persons with which they disagree.

Ah yes, the loving tolerance of Leftists and Islam, embracing peace, understanding, true diversity of thought and speech on as many levels as possible, expanding outreach and encompassing a startling inclusivity offered to all philosophies and beliefs.

A professor at Southern State Community College is currently under investigation after suggesting via social media that the mass murder of 2nd Amendment supporters would help the Left’s gun control cause.

In a Facebook post last month, Ohio adjunct professor James Pearce said the only way for the left to win its gun control battle is for “a bunch of us anti-gun types” to “arm ourselves, storm the NRA headquarters in Fairfax, VA, and make sure there are no survivors.”

Placed into the clear digital ether in black and white.  Retrievable.

My first question: do you think adjunct professor Pearce is “kidding”?  Do you think he “doesn’t mean it”?

These days, I’d attribute the veracity of his statements as I would those of Barack Hussein Obaka.  He meant every damned word.  But what did he actually write and post?  Oddly enough — and you would expect no less — I have it.

Pearce’s post has since caught the attention of law enforcement authorities and an investigation is underway.

The professor is protesting the conservative backlash and criminal investigation into his post, saying it’s obvious that the people he threatened can’t take a joke.

“It was suppose to be a joke, folks. I really do think that Facebook needs something like a ‘sarcasm punctuation mark,’” he said. “The less literate among us don’t seem to recognize humor when they see it.

Right.  The unwashed amongst us, the Proles, the Serfs, the Underlings, the Commoners.  The arrogance drips from his every word.

This is the man who wouldn’t know a handgun from a rifle, a hard day’s work, sweating for a living, a student not bowing down before his swelled cranium.

One can immediately suss that Professor Pearce is the person upon which one would rely should you encounter some kind of violent critical incident, yes?  Yes.  His persona is such that he would fight tooth and nail for you and me.  He would obviously be not unlike Brave Sir Robin.

He’s the typical GOWP: Guilty Overeducated White Person, who has been taught, but has learned little about life.

He can’t understand the fuss.

Right.  Smart guy.

New confiscatory CA gun law as of 2016

California law allowing seizure of guns without notice begins Jan. 1

Gun control legislation going into effect in California next week will allow authorities to seize a person’s weapons for 21 days if a judge determines there is potential for violence.

Proposed in the wake of a deadly May 2014 shooting rampage by Elliot Rodger, the bill provides family members with a means of having an emergency “gun violence restraining order” imposed against a loved one if they can convince a judge that this person’s possession of a firearm “poses an immediate and present danger of causing personal injury to himself, herself or another by having in his or her custody or control.”

“The law gives us a vehicle to cause the person to surrender their weapons, to have a time out, if you will,” Los Angeles Police Department Assistant Chief Michael Moore told a local NPR affiliate. “It allows further examination of the person’s mental state.”

AB1014 was passed last year in the wake of 2014’s Isla Vista shooting, where teenager Elliot Rodger went on a rampage near the campus of the University of California, Santa Barbara, killing six people along with himself.

Further:

The new law is intended to stop such a situation from re-occurring. Under the law, a judge has the power to grant a restraining order telling police to seize a person’s guns, based solely on accounts from family members or police that the person is poses an imminent danger to others. The restraining order can be granted without the affected person knowing it exists or being allowed time to contest it.

Once granted, police can use the restraining order to confiscate all of a person’s guns and ammunition, and the person is also barred from buying or possessing guns and ammo for the duration of the order. A full court hearing must then be heard within three weeks. At that hearing, a judge will be able to extend the restraining order for an entire year.

My interjection:

That is not unprecedented in Fornicalia.  As a peace officer, if I made a detention under 5150 W&I and determined that someone fell under those parameters, I could legally confiscate their guns on that call.

5150(a) When a person, as a result of a mental health disorder, is a danger to others, or to himself or herself, or gravely disabled, a peace officer, professional person in charge of a facility designated by the county for evaluation and treatment, member of the attending staff, as defined by regulation, of a facility designated by the county for evaluation and treatment, designated members of a mobile crisis team, or professional person designated by the county may, upon probable cause, take, or cause to be taken, the person into custody for a period of up to 72 hours for assessment, evaluation, and crisis intervention, or placement for evaluation and treatment in a facility designated by the county for evaluation and treatment and approved by the State Department of Health Care Services. At a minimum, assessment, as defined in Section 5150.4, and evaluation, as defined in subdivision (a) of Section 5008, shall be conducted and provided on an ongoing basis. Crisis intervention, as defined in subdivision (e) of Section 5008, may be provided concurrently with assessment, evaluation, or any other service.

When I made a commitment under 5150 W&I, I was legally bound to inquire about firearms in the affected household and then book them for safekeeping when they were brought to my attention.  My failure to do that would have resulted in my receipt of discipline, at minimum.  Once the commitment was accepted, should that occur, the firearms per Cal DOJ were not to be returned for a period of five years.  One can petition the local court in which the guns or deadly weapons were confiscated.  California section 5250 W&I (Welfare & Institutions code) deals with firearms following a 5150 W&I hold being placed.  I was very careful when placing said holds and sometimes refused to make them against the wishes of family members — who could have an agenda.

In the new instance, however, under AB 1014, weapons can be confiscated in lieu of a 5150 hold and the injection of law enforcement in an emergency situation.  I only found myself involved, as a law enforcement officer, in an emergency call.  Here is the very important caveat:

Practically, this means once you are his with the restraining order you will never own a firearm again for the rest of your life and the ones the police take from you will never be returned. Is any California judge going to lift the restraining order and take the risk that at some later point you may be involved in a shooting of some kind? No.

So, do you, the subject of such an action have the right to be notified that such an allegation has been made against you? Do you have to right to contest their application? Can you contest the ability of the state, without anything approaching probably cause, to have you hauled in for “mental evaluation?” (Why is it that totalitarian regimes invariably use the mental health system to deal with dissidents and non-conformists?) Nope.

How will you find out? When a SWAT team shows up at your door to take your weapons and cart you off for a mental health evaluation.

Beware.  It is, after all, Fornicalia.  And there is a reason I call it that.

A “mass stabbing” in Yolo County, Fornicalia, injured six persons seriously this past Saturday, the 17th.

MADISON, Calif. (KCRA) —Six people were stabbed during a girl’s birthday party Saturday night in Madison, a town 11 miles west of Woodland, the Yolo County Sheriff’s Office.

The band member said two of his band mates were stabbed. A woman who tried to stop the suspect was also hurt. Other witnesses said two of the six victims were airlifted to a hospital.

A machete attack in Stockton then occurred on Sunday the 18th, involving Mel and Big Block Loc, from the StocktonRecord.com:

STOCKTON — Two men armed with machetes confronted a man just south of downtown Sunday concerning the theft of a bicycle. They assaulted the man, leaving him with a large cut on his head, police reported.

The noon incident occurred in the first block of West Scotts Avenue near South Commerce Street. Police reported the 28-year-old victim was treated at an area hospital for a non-life-threatening wound on his head.

His assailants were both described as men in their 30s. One had dreadlocks and is known as “Mel.” The other suspect is known as “Big Block Loc,” according to police.

There was a second stabbing in Stockton, on Sunday the 18th.  From the StocktonRecord.com:

Man stabbed in neck

STOCKTON — During an early morning altercation Sunday in north Stockton, a 25-year-old man was stabbed in the neck and his attacker was arrested, police reported.

The incident occurred about 5:34 a.m. in the 4400 block of Cotton Court, a short street just north of the Calaveras River off East Bianchi Road east of North El Dorado Street.

The victim was transported to an area hospital for treatment of a non-life-threatening stab wound, according to police.

Officers arrested Gregorio Cisneros, 21, on suspicion of assault with a deadly weapon, according to a report.

A fourth deadly stabbing occurred in the city of Modesto, on Sunday morning the 18th.  Again, from KCRA.com:

MODESTO, Calif. (KCRA) —A man died after he was stabbed Sunday morning at a Modesto car wash, police said.

The 39-year-old man was stabbed multiple times around 11:45 a.m. at the business on Yosemite Boulevard, near Rosina Avenue. Police said the man was taken to a nearby hospital, where he later died. No other information about the victim was released.

These four separate incidents involving edged weapons in northern Fornicalia, all within a 60-mile radius of Sacramento — the Belly of the Bill Beast — occurred in the span of a single weekend; just two days.  That’s just one 60-mile-radius within roughly one county.  There are 58 counties in Fornicalia.  Multiply this edged weapon activity times 50 states.  Per day.  There are 365 days in a year.  You get the point.  (Sorry.  Couldn’t help that.)

People shouldn’t have to worry about knife attacks.  Clearly the persons using knives against others in violence are mental defectives or abject criminals.

One thing we do know, however, is that there won’t be a state or federal hue and cry to abolish knives or edged weapons, despite the statistics involved.

For example, according to crime statistics from the FBI, knives are consistently used to kill people far more often than rifles are used. Five times as many murders were committed with knives than were committed with rifles last year.  But again, people screaming for knives to be banned over rifles?  Anyone?  Bueller?

Murder rates before and after gun bans?  Guess what?  The rates don’t plummet.  Ask the residents of Baltimore, DC, Detroit, Chicago and even the UK.

Recently, we’ve all heard that both Obama and Hillary Clinton point to Australia with regard to outright gun confiscation — something they think might be a great idea for the United States despite that pesky and confounding Second Amendment.  They both fail to learn from history.  I call that Historical Alzheimers.

In Australia, it turned out that 640,381 personal firearms were destroyed by the government, costing taxpayers $500 million dollars.

That first year, homicides went up 3.2%.  Armed robberies went up 44%.  In Victoria, homicides utilizing firearms went up 300%.

But here’s the rub, Leftists.  Guess who failed to turn in their guns?  Why yes, morons, the criminals.  That’s their job.  Check the job description.  Then check the definition of the word “criminal.”

I know I should be, but I’m not yet a member of the NRA.  Looks like I’ll be joining this week.  And here’s another odd rub: gun sales the past few months have been skyrocketing.  More weapons in the hands of — gulp! — people who actually qualified for the purchase of their weapons.  Just like the shooter in Roseburg.  Every purchase was lawful and conformed to all regulations.  There’s only one final regulation left.  You know which one.  The ultimate regulation.  I’m sure the Australians were thinking the same thing: “it can’t happen here.”

Marcus Luttreall — the SEAL who wrote the book Lone Survivor, nails my feelings precisely.  I surrender my firearms to no one, man or beast.  And as an Oathkeeper, I have sworn to uphold the US Constitution and our Bill of Rights against all enemies, foreign or domestic.  No one said my oath stopped when I retired after 41 years in law enforcement.

As of last year, there was a 73% opposition to a ban on handguns.  63% of persons said that a home was safer with a firearm present in the home.

This is another Leftist move — and make no mistake, the ultimate wet dream of Leftists is gun confiscation.

I am The Realist.  And make no mistake, the reality is that the phrase “molon labe” has real meaning for me.

Another reason that this government and the UN are in the process of attempting to remove out First Amendment rights — our very right to communicate.  Communication that provides opposition to the defeatist, unsound, illusory, unrealistic, naive and just plain stupid goals of Leftists and this current administration.
