Direct from Fornicalia: Baby taken from Sacramento parents who wanted a second opinion, judge expected to address case

On Monday, a judge is expected to weigh in on a local custody case that revolves around a young Russian couple living in Sacramento, California and their 5-month-old baby boy that was removed from them by Child Protective Services last Wednesday.

It all began when Anna Nikolayev and her husband Alex took their 5-month-old boy Sammy to Sutter Memorial Hospital to be treated for flu symptoms two weeks ago, but said they were not happy with the medical attention their son was receiving from the staff members, according to KXTV news.

Okay; sounds logical.  Let’s continue:

Since Sammy also suffers from a heart murmur, doctors at Sutter admitted him to the pediatric ICU to monitor his condition. After a few days, Anna said doctors began talking about heart surgery.

During their stay at the hospital, Anna asked once why a nurse was giving her son antibiotics.

“I asked her, for what is that? And she’s like, ‘I don’t know.’ I’m like, ‘you’re working as a nurse, and you don’t even know what to give to my baby for what,'” Anna recounted the event. Her enquiry potentially protected the little boy because later a doctor said Sammy shouldn’t have been on the antibiotics in the first place.

This sounds not-so-good.  A nurse not knowing why she’s administering a drug to a baby?

The couple promptly took Sammy out of the hospital without a proper discharge and sought a second opinion at rival hospital Kaiser Permanente.

Ah; there you go: a rival hospital.

While the Nikolayevs were at Kaiser, police arrived, presumably called by doctors at Sutter Memorial. Anna was forced to show the police a note from a Kaiser doctor, which read: “I do not have concern for the safety of the child at home with his parents.”

“[The police] saw the baby was fine,” Anna said. “They told us that Sutter was telling them so much bad stuff that they thought this baby was dying in our arms. So police saw the report from doctors and said, ‘Okay, you guys have a good day,’ then walked away.”

At this point: a problem.  Then likely a problem solved.  But it doesn’t stop there.  Continuing:

Just a day after Sammy was discharged home, police along with representatives from Child Protective Services (CPS) entered the family home without a warrant and took Sammy from Anna’s arms and walked out. A camera that Anna set up in the living room recorded the entire event. In the video, a police officer is heard telling Anna “I’m going to grab your baby, and don’t resist, and don’t fight me, okay?” 

Sammy remains in protective custody at Sutter Memorial Hospital, and his parents are only able to visit him under supervision for a few hours a day.

To which I respond: what the Hell??

Is the issue, truly, that doctors can no longer be second-guessed?  And police are entrapped between?

Frankly, ladies and gentlemen, at first blush, this completely stinks of police/government intrusion and wrongful intervention.

  1. I remember when they first started involving the police way back in 2002. This was when the child protective services were losing kids left and right, and had no accountability since once it was found out what a lousy job the CPS employees were doing, they would simply quit. After all, they weren’t licensed or sworn, had almost no training, and most of all, no accountability. So, they made every CPS agent assign a police officer to his cases. Basically, the cop was there to make sure the CPS that if the CPS agent ever quit, there would at least be a paper trail as to what happened. What I found disgusting is that the police depts received no add’l money from the state, and the CPS departments still got all their funding, but they made the cops now do all the paperwork documentation and responsbile. The CPS agents, now no longer burdened with paperwork, could not file and harass twice as many parents since now all they had to do was call the police agency, assign them the case, and meet the officer and hand over a copy of their complaint. I remember doing at least one a day shortly after this BS started.

    Therein lies the problem, the police have absolutely no input, his own investigation or descretion as they must accept everything told to them by the CPS agent at face value…meaning the parents were guilty until proven innocent. Only now, the parents are not facing some lackey at CPS, to which they could kick them out of their home, they have to face an armed police officer, thus removing their ability to resist.

    I assure you the officers HATE this part, but what can they do. The state dumped it into their laps since they could not make the CPS agents accountable. Maybe they should make these CPS idiots get similar training, and become sworn officers, so that if they screw up, they can’t just quit their job and get another one elsewhere without their poor performance records following them.

    This is a no win situation and since doctors and nurses are fallible humans with devious streaks, they can abuse their power if a parent pisses them off. This is what you get whenever someone says “The government needs to do something about this” or you state “There oughta be a law”. Well, when the govt hears this, this is what they do. Now picture trying to undue this bad law or getting rid of this useless agency…never happen. They now exist in perpetuity, sucking up tax dollars, with increases every year and never a worry about losing their jobs. SAD.

    • Dekar, in Fornicalia it began WAY before 2002. If you take this thing at face value — and I suspect there’s a lot more here — it doesn’t make much sense. The parents checked the child out and, likely, somebody got pissed and decided to drop a dime. Now, whether the infant was in actual danger, I’m not convinced. But, were I the supervisor on this call, my troops had best have some very clear and convincing information to indicate the parents were working against the best interests of the child.

      I AM the government, and sometimes I hate us.
