Sen Lindsey Graham SKEWERS A.G. Eric Holder

Senator Lindsey Graham completely skewers Attorney General Eric Holder in this open session — with regard to trying 9/11 terrorists in a civilian New York court — and lances him with Logic. Leftists hate facts and history, and Graham takes the fact knife and deploys it sharply. To wit:

  1. Let me make a brief statement about Miranda here, as the cartoon reminds me of it. Miranda and its admonishment, in a civilian setting, is a three-pronged application; it must occur when there is:

    1. Custodial
    2. Interrogation
    3. By a peace officer

    In the case of the military, the broader view of “peace officer” actually means an “agent of the state.” Security officers at, say, Target, detaining a person for shoplifting have no mandate to Mirandize as they are agents of the store and are not peace officers.

    There is no mandate to Mirandize over the phone because there is no “custody” per se; you can hang up at any time.

    If a peace officer arrives at a traffic collision and says “What happened here?” there is no mandate for Miranda because there is no interrogation; the question is broad, general, and you are not the focus as a “suspect.”

    As far as I know about the facts of the KSM case, at no time was any form of Miranda applied. In any other civilian court these are, in a crime of this or a similar level, huge grounds for disimssal.

    Here’s the conundrum: either the KSM case gets vacated on its face, or the court is about to change the application of Miranda. I see no other way to interpret.

  3. Well I’ll give him kudos for the verbal gut pile he left on the ground after that….Mr Graham lost a lot of respect from me recently but this particular line of questioning went a long way to regaining some of it.
    I wish we could find someone that would do EVERYTHING I agreed with all the time, but unfortunately I think that’s a pipe dream…Well until I decide to run for POTUS in which case hell would have surely frozen over.
