California’s supreme court ruled that a ban on gay marriage was unlawful Thursday, effectively leaving same-sex couples in America’s most populous state free to tie the knot in a landmark ruling.
In an opinion that analysts say could have nationwide implications for the issue, the seven-member panel voted 4-3 in favor of plaintiffs who argued that restricting marriage to men and women was discriminatory.
Today the California Supreme Court handed down a ruling which legalized same sex marriage in California. The California Defense of Marriage Act, also known as Proposition 22, was found to be unconstitutional by the high court. Passed by the voters in March of 2000 by a wide margin (61.2%) the law was codified as Section 308.5 of the Family Code and stated: “Only marriage between a man and a woman is valid or recognized in California.”
Chief Justice George wrote the opinion for the court and was joined by Justices Kennard, Werdegar and Moreno. Justice Baxter wrote a concurring and dissenting opinion joined by Justice Chin. Justice Corrigan also wrote a concurring and dissenting opinion. Six of the seven justices on the court were appointed by Republican governors.
This is not the last word on this issue. In November the California voters will be presented with an opportunity to amend the California Constitution via the Marriage Protection Act. Should the Act pass, it will not be subject to review by the California Supreme Court.
Brad Dacus, president of Pacific Justice Institute, stated, “This is a classic case of judicial activism at its worst. This decision will now make the passage of the Marriage Protection Act critical for the survival of the will of the people of California.”

But the bottom line: I’m not giving up on this state — either to ILLEGAL MEXICAN INVADERS or to the Socialists, Ararchists and Leftists that line its HEAVILY POPULATED areas.

I know I shouldn’t be surprised but I couldn’t believe it when I saw this today. Talk about not listening to the voice of the people or following the constitution.
People say there’s no country better than America, well I say there’s no state better than California. I’ve been to everyone and California takes the cake hands down.
Do Gay Marrages effect the surf, NO. Do gay marrages effect the fly-fishing, NO. Do gay marrages effect a drive down Highway 1, NO.
Turn the News off, put down the Newspaper, get the family and hit the road and you’ll see, California is one great place.
Get out to see CA… if you can pay the taxes on everything… there really are some nice places to visit, but I can’t afford to live there. I’ll head out to the Western part of the People’s Republic of Washington… the part where guns and civility are understood, not the Seattle part.

I’m from California. I was born and married in that state. I love upstate CA. It’s gorgeous! I didn’t enjoy Los Angeles (where I was born and married) at all. The only good thing I can think of regarding LA is my husband, and incidently, he hates the place too.
I think that if the majority of the people in California are being ignored in that their votes don’t count, they need a revolution. I wouldn’t live there anymore if I was paid to. Fortunately, I doubt anyone is going to make the offer so it’s a statement that’s very hard to prove, but I swear I mean it.
Once again a bunch of judges have no Idea of the difference between the legislature and the court. judges are not supposed to write law! any judge who attmpts to legislate from the bench should not just be impeached but disbarred as well as it is obvious they have nothing but contempt for the law.

I posted on this and brought out the same point you did. WELL SAID.. It is true now anything will go in California. You can marry your dog, cousin, a child etc.. HOWEVER I loved the logical extension you made in regard to churches feeling the punch being forced to marry gays, pedophiles, dogs whatever comes their way.
It is true. That is what will happen in California and it won’t be long until it comes here.
